I can attest to the fact that sometimes the fish we are hoping to catch is just out of casting reach. This is a site that not many have seen, and getting an aerial view of the battle can be not only exciting but beneficial in helping you keep the fish on the line.

Hobbyists are only required to follow the Federal Aviation Administration’s Special Rules for Model Aircraft. As well as those basic rules drones are not allowed to be flown near other aircraft, over groups of people, over any stadiums or events, and must not interfere with any emergency response vehicles or efforts.

The first law (He 1027) states that local governments can not create their own laws the regulate the use of Unmanned Aircraft Systems (drones); however, they are permitted to create ordinances and restrictions on drones. Drones cannot be used to take pictures or videos of any private property, owner, or person without their consent.

Law enforcement officials are only allowed to use a drone if they have a warrant, there is a terrorist threat, or if there needs to be action taken immediately to prevent a loss of life. Law enforcement is also permitted to use a drone when searching for a missing person.

Drones are then prohibited from being flown within 25 feet of any buildings, power lines, people, or light fixtures in the town of Bonita Springs. Furthermore, the city of Miami reemphasizes that drones are not able to carry any type of “detachable cargo” or weapon.

In Defining Springs, drones cannot fly over anyone’s property (public or private) without consent. Any drones that are being used for commercial use are also required to register at the police department prior to use inside the city.

In Orlando Florida, the city placed more restrictions on how closely drones are permitted to fly to people. City parks, schools, or site such as the Amway Center, Harry P. Led Gardens, Camping World, etc can not have drones within 500 feet of them.

Large fines will apply to anyone who violates the above regulations for any of the cities or locations. Below I have described how you can drone fish and avoid breaking and rules or laws.

The simplest form of quick release is to attach a hook to the bottom of your drone with the opening facing the frontwards. Let your line out on the reel and send the drone out to your desired location.

Bring the drone back to the shore and close the line on your reel. Lower the drone until it is either just above the surface of the water or until the hook is submerged (this will depend on the type of fish you are attempting to catch).

These are drone laws that apply to every state in the U.S., including Florida, and were created by the federal government. To fly a drone as a hobbyist in the state of Florida (i.e. for fun / pleasure) you are required to follow the FAA’s recreational model aircraft rules.

One of those rules is that if your drone weighs more than 0.55 lbs (250g), you’ll need to pay $5 to get it registered over here. To fly a drone as a government employee in the state of Florida (i.e., for a police or fire department) you may either operate under the FAA’s Part 107 rule or obtain a federal Certificate of Authorization (Coal).

This law pre-empts local regulation of UAS so that only the Florida Legislature can make laws concerning the use of drones in the state, but allows local governments to enact drone ordinances related to nuisances, voyeurism, harassment, reckless endangerment, property damage, or other illegal acts. All drone pilots operating commercially in the state of Florida are subject to the FAA’s Part 107 rules.

If a facility is fenced, has signs up saying things like “authorized personnel only” and otherwise looks like it doesn’t want just anyone pops in for a visit, you can’t fly their chum. You can’t use your camera drone to capture images of people in private places such as their home where they’d have a reasonable expectation of privacy.

It’s also OK to take images that don’t capture information about people’s private lives in order to do things like property appraisal, gas line inspection and other reasonable business and government use cases. If someone feels you’ve violated their privacy or otherwise caused them injury by using your drone then they can seek punitive damages against you.

Florida ’s laws also make provision for some pretty steep damages, more so than usual apparently. Since drones are still a relatively new thing you can expect quite a lot of amendments to existing laws and additions of new ones in the future.

There’s also a proposal on the books that would prohibit registered sex offenders from using drones, for obvious reasons. Florida also wants drone operators to be held liable for injury or damage caused by pilot error.

With a little homework and diligent application of the laws you’ll be having a ball flying in the sunshine state in no time. However, until the fact of preemption is settled in court you’re better off obeying state laws or face penalties in the meantime.
